Minutes of Planning Committee Meeting Wednesday, 16th January 2019 in the Church Hall, Church Farm Lane, Sidlesham at 6.00 pm

Members of the Council and the public were informed that the meeting will be recorded.

Present:  Mr A Harland, Mr M Mellodey, Mrs C Ranjbar, Dr F Lewis, Mrs M Monnington, Mr R Ryder, Mrs U Pearce, 1 member of the public, Cllr P Montyn (WSCC), Cllr P Tull (CDC) and the Clerk, Mrs T MacIntyre.
1.    Apologies for absence:  Mr P Bedford and Mrs C Hall.
2.      Minutes of Planning Committee Meeting held 10th December 2018 to be signed as a correct record.  Mrs Ranjbar proposed and Mr Mellodey seconded that the minutes be approved.  All agreed.
3.    Declarations by Councillors of personal interests in items on this agenda.  None.
4.    Matters arising from the above minutes not dealt with in separate items below.  None.
5.    Confirmation of Planning Application decided by email
5.1    SI/18/03262/ELD - 62 Street End Lane Sidlesham PO20 7RG
Existing lawful development certificate for the use of the site (shown in red on location plan) as a single C3 dwelling house with ancillary garden land, outbuildings, pedestrian/vehicle access and hardstanding.
No objection to resubmitted Application.  The PC had no objection to original Application.
Confirmed unanimously.
6.    New Planning Application for Discussion
6.1    SI/18/03162/FUL - Gatehouse Nursery, 88 Fletchers Lane Sidlesham PO20 7QG
Erection of 1 no. 3 bed dwelling - alternative to Class Q Prior Approval SI/17/03460/PA3Q for Change of Use from Agriculture to 1 no. 3 bed Dwelling (C3 Use Class). (Variation of condition 2 of permission SI/18/00691/FUL - increase in roof pitch to accommodate pv panels, changes in fenestration on south elevation and siting of new build).
The PC had no objection to the change in the design of the building but remains concerned that the area enclosed by the red line is larger than the allowable residential curtilage, particularly the area to the south of the building.
6.2    SI/18/03322/FUL - Land West Of 63 Street End Lane Sidlesham West Sussex
Erection of L shaped stable block.
The PC objects to this Application.  If the horses are to be supported by feed imported to the site then a change of use is required. This proposal represents a substantial loss of horticultural land.
6.3    SI/18/03379/PA3Q - 63 Street End Lane Sidlesham Chichester West Sussex
Class Q application for Prior Approval - Change of use from Agriculture to Dwelling (C3 Use Class).
The PC sought clarification on the eligibility of the building because of the length of time since the building had been used for agricultural/horticultural purposes and the extensive repairs carried out. It questioned whether the building, with the works undertaken, constitutes the same structure that qualified under the legislation.  In addition, the drawings did not indicate that the drive would be shared.  The Parish Council agreed that the 3 buildings on this small plot of land constituted overdevelopment.
6.4    SI/18/03376/DOC - 63 Street End Lane, Sidlesham, PO20 7RG
Discharge of condition 1 from planning permission SI/16/00472/PA3Q - change of use of
agricultural building to 1no dwelling (C3 Use Class)
No objection.
6.5   SI/18/03252/LBC - The Old Doctors House Highleigh Road Sidlesham PO20 7NR
Proposed partial demolition of residential accommodation and replace with 2 single storey extensions, including a new front porch and entrance, a single storey orangery and minor landscaping amendment works.
No objection.  Unanimous decision.
6.6    SI/18/03429/ELD - The Fairways Brimfast Lane Sidlesham PO20 7PZ
Existing lawful development certificate for use as commercial storage (B8).
The PC had no objection to this Application.  However, it would like CDC to investigate the S106 agreement entered into by the Applicant in 2004 in which the applicant committed to demolish the existing residential property on completion of the new building, along with other structures on the site. The building now stated as benefiting from eligibility for an ELD was one such structure and the PC believes that the S106 would prevail as a legal agreement over the ELD.

The Clerk was asked to write to Enforcement to enquire whether the new house has been completed and the caravan removed.

Replacement garage.     PERMIT.
7.4    SI/18/02926/TCA - Oakdene  Mill Lane Sidlesham PO20 7NA
Notification of intention to crown reduce by 30% on 1 no. Oak tree (T1) and 1 no. Maple tree (T2) and  1 no. Ash tree (T3). Crown reduce by 25% on 1 no. Pittosporum tree (T4).
NOT TO PREPARE A TREE PRESERVATION ORDER.

Retrospective erection of boundary fence.   PERMIT.
7.6    SI/18/02377/FUL - Tony Partridge Autos Zsaras Yard Highleigh Road Sidlesham PO20 7NR
Retrospective application for the continued use of land for the stationing of a residential static caravan for occupation by an employee of Tony Partridge Autos.  REFUSE.
7.7           SI/18/02115/FUL - Gnomesville Lockgate Road Sidlesham Chichester West Sussex PO20 7QQ
Erection of a single-storey workshop at an existing business premises.   WITHDRAWN.
7.8       SI/18/02993/FUL - 36 Chalk Lane Sidlesham PO20 7LW
Erection of 1no. 3 bed dwelling as alternative to planning permission SI/18/00209/FUL.
PERMIT WITH S106.
8.           Planning Correspondence and other planning matters.
8.1     Hatchers.  The Clerk had received a letter from CDC Enforcement in which it was stated that the new fence replaced an existing hedge and that the Common Land had always been accessed through the drive.  This remains the position.  The PC objects to the fence, erected on Common Land without Planning Consent.  A decision on the PC’s future course of action was deferred to the February meeting.
